Woman drags Kano industrialist, 5 others to court over intellectual property, seeks N250m compensation

Hajiya Habiba Aliyu Aliyu, a resident of Unguwar Dosa, Kaduna state on Thursday asked the Federal High Court, Kano to grant her N250m as compensation against Mudassir, Mudatex and Brothers and 5 other defendants for alleged infringement on the right of her deceased daughter, Nafisa Aliyu.

In a civil suit before the court, Hajiya Aliyu claimed that the defendants allegedly committed intellectual theft by marketing the pictures and artworks of her late daughter on their textile materials without her consent or that of her late daughter.

Hajiya Habiba Aliyu, said she approached the court seeking for Justice against the defendants who allegedly copied the artworks of her late daughter, Nafisa Ibrahim from her Facebook page and used it to attract the customers on their textile goods globally.

Barrister Aliyu Suleiman Jatau, lead counsel to the complaint argued that selling, marketing retailing and distributing of Mudatex textiles materials and products of other 4 defendants with the artwork pictures of her deceased daughter infringed on her right.

Other defendants in the suit are Ms Ling Haiying, a Chinese national, Hongkong Runda Textile Company Limited, Mudatex Brothers, Dan Kano na Kano and Sani Tahir.

When the case resumed for hearing, only Sani Tahir’s Counsel, Barrister Nuraddeen Ayagi attended the session but none of the 5 defendents or their lawyers attended the proceedings.

Barrister Nuraddeen Ayagi filed preliminary objection against the plaintiff arguing that his client Sani Tahir has no case to answer.

Justice Saadatu Ibrahim Mark of federal High Court Kano, adjourned the case to 1st of December 2020 to hear the preliminary objection by Barrister Nuraddeen Ayagi.
