Justice Nkeonye Maha of the Federal High Court sitting in Abuja on Wednesday refused to hear a bail application filed by Mr Omoyele Sowore, Convener, #RevolutionNow protests, challenging his detention for 45 days by the Department of State Services(DSS).
Sowore through his lawyer, Mr. Femi Falana (SAN), had urged Justice Maya to review and set aside the exparte order of his brother judge, Justice Taiwo Taiwo on the ground that the order was made in error.
However, Justice Maha in a bench ruling on Wednesday held that she lacked jurisdiction to hear Sowore’s bail request.
According to her, the court that granted the detention order is a court of equal jurisdiction, whose decisions can only be set aside by an appellate court
