The Supreme Court has struck out an appeal lodged before it by the Peoples Democratic Party and its presidential candidate, Alhaji Atiku Abubakar.
Delivering judgement on the appeal on Tuesday, a five-member panel of the apex court led by Justice Dattijo Muhammad held that the appeal was statute-barred.
The appeal was filed by the PDP and Atiku to challenge a ruling of the Presidential Election Petition Tribunal which held that they failed to file a response to an application by the All Progressives Congress (APC).
The APC’s motion had urged for the dismissal of the appellants’ petition at the tribunal.
Atiku and the PDP are challenging the victory of President Muhammadu Buhari at the February 23, 2019 election.
The Supreme Court’s verdict came almost 24 hours to the closing of arguments by parties at the Presidential Election Petition Tribunal slated for Wednesday.
